Terms of Participation

Organizer

The provider of the website and organizer of the competitions is ÉCLAT GmbH, Kirchstraße 19 A, 35463 Fernwald (hereinafter referred to as “ÉCLAT”). The contest is not affiliated with Facebook and is in no way sponsored, supported, or organized by Facebook. By registering for the contest, the participant acknowledges this and releases Facebook from any claims arising from or in connection with participation in the contest.

Participation and Eligibility

Participation in the contest and the submission of personal data is voluntary and free of charge. Participation is subject to these contest terms and conditions. Individuals who do not agree with these contest terms and conditions may not participate.
Eligible to participate are individuals who have their permanent residence in Germany at the time of participation and are at least 18 years old. Employees of ÉCLAT are excluded from participation.
By registering and participating, the participant declares that they are eligible and agree to the contest terms and conditions.
To successfully participate in the contest, the described instructions in the respective Facebook/Instagram post must be followed. Additionally, the participation period specified in the post applies. Each person can only participate once and only through their Facebook/Instagram account in the contest. The participant must ensure that their comment does not violate applicable law. ÉCLAT reserves the right to delete entries that violate the participation conditions, German law, copyright, or public decency and to exclude the author from participation.

Drawing, Winner Notification, Claiming Prizes, and Forfeiture of Prizes

Entries posted outside the participation period or in ways other than through the comment function will not be considered. The timeliness of participation is determined by the electronically recorded receipt of the comment.
The winners will be randomly selected after the end of the contest in accordance with the indicated end date and notified by a response under their own comment under the contest post or by a separate post on ÉCLAT's Facebook/Instagram page. They will be requested to provide their complete contact details. For privacy reasons, the transmission of contact details will be done via Facebook/Instagram direct message to ÉCLAT.
After notification, winners have three days to contact ÉCLAT via direct message. If a winner does not respond within the specified period, the respective prize will be re-drawn to another participant.
A cash payout of the prizes is not possible. The legal process is excluded.

Exclusion of Participants from Competitions

ÉCLAT reserves the right to exclude participants who violate these contest terms and conditions or attempt to gain an advantage through manipulation from participating in the current and future contests.
A participant may be excluded if they are not eligible to participate; have provided incomplete or false information at the time of participation; used unauthorized aids or gained undue advantages through technical or other manipulations; engaged in fraudulent actions in connection with participation; violated applicable laws through participation or exhibited otherwise unfair or irregular behavior. The same applies to attempts of the aforementioned actions.

Modification and Premature Termination of a Contest

ÉCLAT reserves the right to end the contest at any time, modify its conditions, or change it in any other way. ÉCLAT may also interrupt, cancel, or terminate the contest at any time without prior notice if malfunctions, disturbances, manipulations, viruses, or similar occurrences impair the administration, security, fairness, or integrity of the contest process. No claims can be derived from an interruption, cancellation, or premature termination of the contest. A corresponding notification of the interruption, cancellation, or premature termination of the contest will be published on the ÉCLAT website or Facebook/Instagram page.

Rights

The participant retains the rights to all content they publish on ÉCLAT's Facebook/Instagram page. By submitting and publishing content, participants grant that these contents may be used and published by us within the ÉCLAT website (www.eclat.de) or on our Facebook/Instagram page.

Disclaimer

ÉCLAT is not liable in any way in connection with the execution of this contest for any indirect or direct damages resulting from participation.
Furthermore, ÉCLAT is not liable for any interruptions or disturbances of the contest that arise due to technical problems beyond ÉCLAT's reasonable control.

Data Protection

By participating in the contest and providing data, participants consent to their personal data being stored and processed by ÉCLAT for the purpose of contest handling. The collected data will be deleted after the end (or handling) of the contest in compliance with legal regulations. The data will not be published or passed on to third parties.

Exclusion of Legal Recourse

ÉCLAT makes all decisions related to the execution of the contest at its sole discretion. These decisions are final, conclusive, and not subject to legal recourse. The legal process is excluded.

Choice of Law

The contest is exclusively subject to the laws within Germany.
